T-bone accident – the second most dangerous crash in the US

When a car slams into the side of another vehicle that is called a T-bone accident. According to the National Safety Council, T-bone accidents are the second most dangerous type of car crash. As the side of a car is less protected and reinforced, this type of accident is more likely to result in serious injuries and fatalities

Recent National Transportation Highway Safety Administration statistics show that each year, approximately 8,000 people are killed in a T-bone accident in the US, while tens of thousands of people are injured, many of them critically.

Most common type of injuries in a T-bone accident

Even if you wear a seatbelt, it may not be enough to protect you from severe injury in a T-bone accident. The people seated on the side that is hit may suffer broken bones, head injuries, back or spinal cord damage, as well as chest injuries.

Such injuries can be life-changing and the financial damages are enormous. If you are ever in this type of crash, the best thing you can do is talk to an experienced Nebraska car accident lawyer as soon as possible.

What type of damages can you recover for a Nebraska car accident?

Nebraska is an at-fault state, which means that you will have to file a claim against the other driver’s insurance or sue them if their liability policy doesn’t cover your damages.

However, you need to keep in mind that Nebraska follows a modified comparative negligence doctrine so you need to be very careful when you talk to the insurance people. If your percentage of fault is 50% or higher you cannot recover any damages. Better let a seasoned Nebraska accident lawyer negotiate with the insurance company.

You are entitled to compensatory damages, which can be:

  • Economic – covering your medical bills and related expenses, as well as your lost wages.
  • Non-economic – compensating you for your pain and suffering, both mental and physical. In Nebraska, there is no cap on non-economic damages so the compensation awarded will depend on the severity of your injuries and the skill of your lawyer.

Unfortunately, you won’t be able to get punitive damages as Nebraska is the only state to rule such damages unconstitutional.
