Auto recalls reached historical levels in 2015.

San Francisco, CA- The family of actor Anton Yelchin filed a wrongful death lawsuit against Fiat-Chrysler alleging that a defect in the Jeep he was driving led to his untimely death.
The Los Angeles Times reports that the Star Trek” actor’s parents filed a wrongful death and product liability claim on August 2nd, alleging that a defect in the gearbox in certain Jeep models, which was the subject of a recall, caused Yelchin’s death. The lawsuit seeks punitive damages, claiming that Fiat-Chrysler was aware of the defect since 2012, but does not specify a dollar amount.
On June 19th, police found Yelchin pinned between his Jeep Grand Cherokee and the gate of his Beverly Hills home.
Gary Dordick, the attorney representing Yelchin’s family, told the Los Angeles Times that Yelchin started his Jeep then exited it to get something from his house when the vehicle rolled backwards. He said that the actor was “crushed and lingered alive for some time,” before he passed away.
Fiat-Chrysler issued a recall for the electronic gearboxes in April because motorists were unable to figure out the gear shift. The National Highway Traffic Safety Administration said that so far there have been 266 crashes and 68 injuries associated with Grand Cherokee recall.

In a report, the NHTSA said gear shifts in 2014 and 2015 Jeep Grand Cherokees were not “intuitive.” The agency explains: “Drivers erroneously concluding that their vehicle’s transmission is in the PARK position may be struck by the vehicle and injured if they attempt to get out of the vehicle while the engine is running and the parking brake is not engaged.”
A wrongful death or personal injury suit that is connected to an auto recall is significantly different than a car accident suit. A car manufacturer or part manufacturer is not considered liable for a deadly or injurious crash. That means victim must demonstrate that the part or model subjected to the recall was the direct cause or a primary contributing factor.
Traffic accident victims who suffer an injury because of a defective auto part need to retain an accident lawyer in San Francisco to work on their claim. An experienced lawyer has the expertise, resources, and skills to prove your accident claim. Ignoring the safety of a motorist is negligent, and car manufacturers can be considered liable if they failed to issue a recall or correct a problem.
