An Alabama man was awarded $7.5 million in damages after falling and breaking his hip in his local Walmart.

That is what happened to an Alabama man who was awarded $7.5 million for a broken hip that occurred when he tripped and fell in a Walmart store.

In 2015, Henry Walker was picking out a watermelon from one of the large cardboard displays used by grocery and retail store to display large produce and merchandise. Walker was unaware there was a wooden pallet under the box as he stepped closer to the display. When he turned to put the fruit in his cart, his foot, which slid between two pieces of wood, got caught and he fell.
Walker broke his hip and suffered other injuries. Now, he uses a walker to get around.
During the civil trial, jurors watched surveillance video of other shoppers getting their foot caught in the wood pallet. The injury attorney representing Walker told AL.com that he hopes the judgment, in this case, will inspire the retail store to use pallet guards.
Walker’s lawsuit claimed wantonness and negligence on Walmart’s behalf. The jury found Walmart liable on both counts and awarded Walker $2.5 million in economic damages and $5 million in punitive damages.
In a statement to AL.com, a spokesperson for Walmart said the award amount was excessive. They maintain that the display is safe and insists Walker was negligent.
Walmart plans to appeal the verdict.
