He was release to his parents but was stopped again, a little over half an hour later, and arrested for leaving his home intoxicated.
A day following the accident, police arrested,  Jeremiah Funke, 18,  after they discovered that De Millo and his four passengers had just left a party at the teen’s house. Funke’s parents were out of time when the party was held. Funke has been charged with possession of marijuana, possession/consumption of alcohol by a minor, and maintaining a disorderly house.
According to reports, friends at the party offered to driver De Millo home but he refused. That bad decision lead to the death of one person and has now landed him in serious legal trouble.
