Boise area motorcyclist is killed in a highway accident involving a truck

Motorcycles offer much less protection than other vehicles during a crash, so these kinds of collisions often result in serious injuries or fatalities.

The Idaho State Police responded to a fatal collision that involved a truck towing a boat and a motorcycle just north of Boise.

State police find motorcyclist died after hitting a truck

The incident took place at mile marker 14.4 on Highway 21, near Hilltop Station. Police believe that at around 9:45 am, a 48 year old male driving a Toyota Tacoma that was pulling a boat was going northbound, while a 49 year old male was going southbound on the highway on a motorcycle. As the truck driver was attempting to make a left turn onto Hilltop Station, the motorcycle rider drove into the front of the Tacoma.

When rescue workers arrived on the scene, the man on the motorcycle was pronounced dead a short time later. The man’s family was notified and medical personnel confirmed that he died from injuries sustained during the collision.

According to the Idaho State Police’s initial investigation, the truck driver was wearing his seatbelt and the motorcyclist did have a helmet on.

There was no word regarding whether the truck driver would receive any citations or be prosecuted. Police officers blocked off traffic in the area for about three hours until the scene was cleared and the road was safe to be reopened.

Getting legal assistance after a family member dies in a motor vehicle accident

There are thousands of Americans who die on the roads in car accidents every year. When this happens, the only remedy available to family members to help them pay for things like funeral and burial expenses, medical treatment, and the relative’s lost wages is a wrongful death lawsuit. This is a kind of civil case that is structured much like a standard negligence action. However, the injured individual is not the plaintiff in the lawsuit, and that role is left to family members or the representative of the estate.

Suing a negligent driver

There will be a number of factual issues that will be considered to determine whether the victim’s family will win the lawsuit. Traffic violations such as speeding or going through stop signs can be used as evidence of negligence. There is also an accident report generated by police which will give opinions as to what happened immediately before the crash. These kinds of evidence will be presented to the jury at trial before they can deliberate and decide who was at fault.
