accidentChicago, IL- A 22-year old man has been charged with multiple counts in association with a fatal Chicago accident that left two teens dead.
Jonathan Hurst was allegedly drunk last Wednesday when he slammed his vehicle into a tree and utility in Park Forest. CBS Chicago reports that after crashing, Hurst fled the scene and sought medical attention at a nearby hospital.
One of the teens was pronounced dead on the scene and the other later died at the hospital, the Chicago Sun Times reported.
He was apprehended after the hospital contacted police, notifying them they had a patient with injuries consistent with a car crash, according to the Chicago Sun Times.
Hurst was treated for minor injuries and released to police who charged him with several felony counts including driving under the influence, reckless homicide and fleeing the scene of a crash involving death.
Drunken driving ranks among the top three causes of fatal accidents in Illinois, and the U.S. as a whole and leads to thousands of unnecessary deaths each year. Distracted driving and speeding account for the other two primary causes, but whatever the cause of a crash, the at-fault driver is criminally and financially liable.
Clients often ask personal injury attorneys what types of compensation  they are entitled to after a deadly crash in Illinois. Most accident victims may realize they can recoup the medical and funeral expenses that result from a major crash along with compensation for their loss of companionship. But what they may not realize is that they are also eligible for punitive damages if the at-fault driver’s actions were egregious.
Punitive damages are awarded on top of the other compensatory damages, an accident victim or their surviving loved ones are awarded. Such damages serve to further punish the at-fault driver if their actions are considered shocking or heinous. Take for example this particular accident, not only was the driver drunk at the time of the crash but he also fled the scene, failing to get the victims timely medical attention that may have saved one of their lives. But he did get medical attention for himself. This young man’s action could warrant punitive damages if a victim has a personal injury attorney to make a convincing case on their behalf and show that a driver deserves increased civil penalties.
