2 people died this past June when a vehicle collided with a pickup truck. The woman, Brenda Casteel Berryman of Decatur, and the man, Bryan Anthony Johnson of Danville were struck head-on, according to the Decatur Daily. They were driving around the 6200 block of Danville road when the collision occurred. Details are unclear, but witnesses and evidence show that after an initial collision, both vehicles caught fire. Edgar Ray Berryman, Brenda’s husband, freed his wife from the vehicle to escape the fire. Johnson also extricated himself from his vehicle. However, while they were out of the car, a third vehicle ran into them while trying to avoid the wreckage. The driver of the third vehicle, Matthew Carrington, was unhurt.
Brenda was dead at the scene, while both Edgar and Johnson were airlifted to hospital. Johnson was pronounced dead on arrival, but Edgar survived with serious injures. Rick Sherman was on the scene after hearing the collision from over 300 yards away. He described seeing Edgar in the ditch with his wife, cradling her. He also spoke with Johnson, who mentioned feeling very cold, and prepared him for the helicopter. There was no word on whether any charges would be laid in the incident.
This accident happened in an instant, as all accidents do. Victims rarely expect accidents before they happen or see them coming. You should try to be prepared to know what to do in case of an accident. In Alabama, insurance can be quite confusing. Alabama is considered to use “fault” insurance. This means that compensation is paid out according to how much at fault the each driver involved is in the incident.
You have several options if you get in an accident. You can file a claim with your insurance company. You can file a 3rd party claim with another driver’s insurance. Or, you could file a lawsuit against another driver or someone you feel is responsible.
In Alabama, you must have liability insurance to cover the costs of any damage or liability to other people and property. It won’t cover anything relating to your injuries or damage, but you have the option to purchase that insurance should you wish.
Because the insurance and liability world is complicated, then your best option, if you’ve been injured, is to contact a skilled attorney to help you with your options. They know the system in and out and will be able to not only provide you with knowledgeable guidance, but they can do all the negotiating and talking for you. An accident attorney in Decatur will investigate your case and make a determination as to what legal precedents apply. Then they will file the appropriate claims with insurance companies, or file a lawsuit, if necessary. Being successful in these endeavors takes the smarts and experience that only an attorney can provide you.  Every step of the way they will fight to protect your rights and work to get you the compensation you deserve.
