At any given time, there are a combination of cars, trucks, motorcycles, and other vehicles on the roads. When smaller vehicles have a collision with a car or truck, the results can be catastrophic.
An accident in Kansas City, Missouri involved a moped that was struck from behind by a Ford sedan.
Moped driver is hurt and his passenger is killed on Highway 9
Police received an emergency call to respond to a crash at the intersection of Highway 9 North and Pacific Street at about 10 pm on a Friday night. As a moped was driving northbound on the highway, a red Ford Fusion drove over the back end of the vehicle. The driver of the Ford claimed he did not see them, and law enforcement confirmed that the rear lights on the moped were not working at the time of the incident. The moped’s driver and passenger were dragged along the road for several feet then eventually ejected. One of them ended up on the hood of the Ford, while the other was sent into an adjacent traffic lane from the impact. The female passenger was pronounced dead on the scene, while the male moped driver was transported to a hospital for surgery with serious and life threatening injuries.
The driver of the Ford vehicle was not hurt at all during the incident.
Accidents that involve mopeds or other types of vehicles
Whether an accident includes cars, trucks, bicycles, motorcycles, pedestrians, mopeds or victims using any other kind of vehicle, a personal injury attorney can file a similar type of lawsuit against the person or business at fault. The same standard of care applies to all drivers on the roads, which means that they can all be sued in a negligence case in a similar fashion.
The defendant must pay for all of the expenses that can be traced by to the accident if they are found to be legally responsible after a verdict or settlement. This normally includes a combination of medical and hospital expenses, property damage, lost wages, and even non-economic damages related to psychological or emotional trauma caused by the collision.
Special concerns for drivers of smaller vehicles
People who drive mopeds, scooters, or motorcycles are always exposed to a much higher risk of injury or death on the roads. This is because there is little to protect them from a collision with a much larger car or truck. Other safety features such as airbags and safety belts are usually not available on these vehicles either. These risks are usually factored into insurance policies for alternative modes of transportation.
Regardless of the extent of the injuries, your personal injury attorney can try to make the defendant in your case pay for everything. A brief consultation can provide you with specific information about how to proceed and what to expect as the case proceeds through the court system.
