Philadelphia, PA- A Texas man whose wife was killed in accident with a duck boat in downtown Philadelphia has filed a wrongful death suit, aiming to take the amphibious vehicles of the road.
On May 10th, Elizabeth Karnicki was crossing 11th and Arch Streets when she was struck by one of the vehicles used to tour by land and water. In the suit, Karnicki’s husband and his legal team stated that blind spots led to the deadly pedestrian crash and suggested that the driver was inattentive, according to Fox News.
Ride the Ducks International LLC released a statement offering condolences to the Karnicki family for their untimely loss, but added that police did not cite the company which indicates that “Ride the Ducks was not at fault,” Philly.com reports. According to the police report, eyewitnesses said that Mrs. Karnicki was looking at an electronic device as she was crossing the street.
But the lawsuit alleges that the duck boat operator was the one who was distracted and was tasked with entertaining passengers while also driving. Ride the Ducks also denies this allegation, stating that they have guides on each trip in addition to the vehicle operator.
In addition to seeking compensation from Ride the Ducks LLC, the lawsuit also names the city of Philadelphia as defendants and asks they take duck boats off the road because they are “clearly a lethal threat to pedestrians,” Karnicki’s attorney Robert J. Mongeluzzi said in a statement.
This the second time in the past several years that Ride the Ducks in Philadelphia has been hit with a wrongful death suit. In 2010, the company was ordered to pay a $15 million settlement to the families of two Hungarian tourists who were killed in a duck boat accident in 2007, Fox News reports.
