A failure to yield the right of way leads to many fatal accidents in Florida.
Broward, FL- Traffic accidents are an unfortunate consequence of driving in South Florida, and the results can be damaging and destructive. Each year in Florida thousands of motorists die in traffic accidents, and those accidents have a variety of causes, which is why our team of accident lawyers in Broward, Florida will discuss a few of the primary causes of car accidents in the Sunshine State.
In many cases, the cause of a traffic accident can’t be pigeon-holed. Instead of an accident being the cause of one action or bad driving habit, an accident is the result of a combination of factors and actions. That is one reason why Florida’s Department of Highway Safety and Motor Vehicles (DHSMV) lists the cause of the majority of fatal traffic accidents as “Operated MV in Careless or Negligent Manner.” This category is the largest, accounting for 634 fatal accidents out of 2,395 in the state in 2013, but is not the only category that doesn’t list a specific cause for a traffic accident.
Police are key in determining the cause of a traffic collision.
The Florida DHSMV has two other categories for fatal accidents with unspecified causes. One is “other contributing action,” which accounted for 278 fatal collisions. The second undefined category is “unknown” and accounted for 271 fatal accidents.
The fourth leading cause of fatal accidents in the Sunshine State is a failure to yield the right of way and led to 440 traffic deaths in 2013. When a motorist takes actions that encroach on another driver’s right of way and causes a crash, they can be cited for failure to yield. For instance, a motorist makes a left turn at a traffic light in front of oncoming cars and gets broadsided by one of them. That motorist though they had enough time to make their turn and ignored the “right of way” of oncoming traffic and “failed to yield the right of way.” That’s just example commonly observed in Broward and surrounding areas.
Drunk or impaired driving and speed, behind the failure to yield, also cause a significant number of fatal accidents in Florida.
