Liquid nitrogen causes mass personal injury and death in Georgia poultry plant.

construction accident

Georgia – January 28, 2021

According to law enforcement officials, six workers suffered fatal consequences, and several others were taken to a hospital after a liquid nitrogen leak at a poultry processing plant in Gainesville, Georgia.  The Hall County fire crews responded to burn reports at the Foundation Foods facility where they found over 100 evacuated employees, and several individuals who were experiencing medical emergencies.  Five individuals suffered fatal medical emergency at the scene and many others were hospitalized.  When unexplained work-related injury occurs, accident attorneys who have extensive personal injury litigation and insurance settlement experience can help victims recover necessary compensation to cover harmful impacts to their lives. Victims and their families should consult with workers’ compensation attorneys for guidance.

Injury damage compensation.

Accident laws provide for compensation, based on assigned fault and proven claims of negligence, when dangerous mishaps occur in the workplace. An injury attorney can explain how the law applies in this setting and offer a timeline for making a legal claim through workers’ compensation, or civil lawsuits. A personal injury attorney at Scanlon and Wojton can explain valuation determinations for damage compensation necessary to address economic loss for lost wages, medical bills, medical care, and treatment, plus household expenses, and non-economic damages, including pain and suffering, loss of consortium, or companionship.  When an injury attorney can prove that a defendant deliberately, with reckless disregard, acted in a manner to cause harm to another person, punitive damages may be awarded in specific situations.

Capitations and time to file.

Monetary awards in Pennsylvania have no cap on most damages, but there is a cap of $500,000 against local government claims, and a $250,000 limit on claims against the State.  Accident lawyers can be of assistance for a variety of legal actions toward fiscal recovery after a work-related mishap leads to medical complications, injury and accidental death. When personal injury is caused by another’s actions, or their negligence  in Pennsylvania, the statute of limitations gives an injured victim two years from the date of the injury to file a lawsuit. An attorney can apprise individuals of any deviations from that timeline.

Workers’ compensation.

When a person becomes injured on the job, or contracts an illness that is job-related, they should hire the services of a workers’ compensation attorney at Scanlon & Wojton who can assist with a claim for monetary damages. Injuries may be caused by an accident, or event that results in a physical injury, a medical condition caused by repetitious use of a body part, or conditions associated with the workplace environment itself. A lawyer can deal with the Pennsylvania Workers’ Compensation claims division  on a client’s behalf.

Wrongful death.

A wrongful death legal action may be initiated by personal representatives, or by loved ones when a person dies because of the negligent, reckless, or deliberate act of another.  Damages in these lawsuits can include medical bills, burial expenses, current and future  lost wages, pain and suffering, and punitive damages if warranted.  An accident victim in Pennsylvania can take time to recover from their injury and allow competent legal counsel at Scanlon & Wojton to work toward a fair monetary settlement on their behalf.
