McCormick County driver killed in highway crash
McCormick County, SC – Motor vehicle collisions are a common cause of death in South Carolina and the rest of the United States. Driving left of the center lane market is one of the main ways that fatal accidents happen, as this means that two vehicles going in opposite directions will likely crash into each other with disastrous results. Depending on the specific insurance in place for the drivers, it may be necessary for those involved to get legal advice and determine if a civil injury case is necessary.
Driver goes left of center on highway and causes fatal accident
The South Carolina Highway Patrol believes that the incident started with a Cadillac vehicle going southbound on Highway 28 near the Melrose Road exit at about 7 pm that night [1]. The driver started to move across the center line towards the traffic going in the opposite direction. The Cadillac then made contact with a Toyota Camry vehicle going northbound. The drivers in both vehicles were confirmed to be dead at the scene a short time later.
The McCormick County Sheriff responded and started to divert traffic from the area near the accident scene and Bethany Baptist Church. One victim was identified as a 36 year old male from Clarks Hill. The identity of the other driver was not released to the media.
Wrongful death laws in South Carolina
There are state laws that allow a person’s family to receive compensation on their behalf if there is a fatal accident. These are called wrongful death lawsuits, and they can be brought in civil court regardless of whether the person responsible for the fatal accident is ever charged with a crime and convicted. The wrongful death case is similar to other personal injury lawsuits, and it needs to show that the defendant’s negligence or recklessness was the direct cause of the victim’s fatal injuries. If the case is successful the family can receive various types of compensation such as the person’s future lost income and wages, their medical treatment costs, and expenses related to their funeral and burial. An attorney with experience in bringing wrongful death cases can describe the process more thoroughly, as there are some differences from other kinds of injury lawsuits.
