According to the CDC, a pedestrian is killed in traffic accidents once every two hours in the U.S. and tens of thousands of pedestrians are injured. In 2012, pedestrian-auto accidents injured 76,000 people in the U.S. That is a large number of people who will suffer debilitating injuries and find themselves buried in medical bills.
In some pedestrian-auto accidents, a pedestrian can actually be at fault. There may be this misconception that a motorist is always at when a pedestrian is struck, but that is not always the case. Pedestrians take risks that put their lives and the lives of others in danger. As a consequence, a pedestrian can be held liable for any injuries or property damage that result.
But the majority of pedestrian-auto accidents are caused by a motorist who is inattentive, speeding or disobeying traffic signals. All motorists have a duty of care which means they are responsible for making certain that they drive safely under the current conditions of the road.
