Jackson County Sheriff Mike Ezell says the incident occurred on Monday, August 31st at around 6:00 p.m. on Davis Sawmill Road, about a half-mile off Mississippi 613. Roketa Smith of George County was driving the vehicle at the time of the incident and a preliminary investigation suggests the mother lost control of her vehicle, went off the road, and crashed into a large pine tree.

Emergency responders say the baby was pronounced dead at the scene and Smith’s nine-year-old son had to be transported by ambulance to the University of South Alabama Medical Center in Mobile. Smith also suffered injuries in the wreck and was airlifted to the same hospital as her son.

Was your child injured in a car accident in Jackson, MS?

If your child was injured in a single-vehicle or multi-vehicle car crash in Jackson, it is best that you consult with a Jackson, MS personal injury lawyer before assuming they aren’t entitled to collect compensation for the injuries/losses they suffered. In most cases, a child is eligible to recover compensation after an accident either from the driver who caused the crash, or the insurance carrier assigned to handle the claim.

How does a parent determine who to pursue for compensation?

If your child was involved in an accident with another party and that person’s negligent or careless actions caused the crash, then you hold the right to file a personal injury lawsuit against that person. If your child is 18 years of age or younger, you would be required to file the lawsuit on their behalf as minors cannot do so on their own. When you choose to file a personal injury lawsuit on behalf of your child, you can request that they be compensated for the following:

  • Pain and suffering
  • Loss of enjoyment of life
  • Past and future medical bills
  • Lost wages (if you were required to take time off from work to care for your child)
  • Mental anguish

Now, if your child was injured in a single-vehicle accident in Jackson, MS, they may still be entitled to recover compensation for their injuries/losses. Typically, this compensation would come from your insurer, however, if it can be determined that another factor played a role in causing the accident (i.e. a defective tire, pothole, etc.), you may also have a case against other parties. As you can see, there is a lot to consider after an accident which is why you are encouraged to contact a personal injury attorney in Jackson, MS who can help you sort everything out and explain what your next steps should be.

When a child suffers a serious or permanent injury, it can have a significant impact on their ability to enjoy life. If your child’s injury has impeded on their ability to live their life in the manner that they would have given they weren’t involved in the accident, it’s time you contact Ballard Law, PLLC.
