body damage in car accidentMiami, FL- Deadly exploding air bags from Japanese manufacturer Takata claimed the life of a Texas teen last week, bringing the death toll to ten. So far, the injury count reaches one-hundred.
According to USA Today, the accident occurred in Texas and caused the death of a 17-year-old Huma Hanif, even though police and witnesses agree it was a survivable accident. Reports say the Hanif was traveling on a state route around 4:30 p.m. when she rear-ended a vehicle at a low speed, causing her airbag deployed. Danny Beckworth, a lead investigator in the case, told the New York Times that Hanif was not speeding, and her car suffered only moderate damage.
Only, the airbag ruptured, and a piece of shrapnel struck her in the neck, causing her to bleed out within minutes. Hanif’s death is the first this year.
Honda told USA Today that Hanif was sent recall notices on several occasions, but the airbag in her Honda Civic, manufactured in 2002, was not replaced.
Over time, the chemical used to propel the airbag becomes unstable, and the bags are prone to rupture, sending metal shrapnel and parts into the faces of drivers and passengers.  So far, 14 automakers have issued recalls for 24 million vehicles in the U.S. Honda has the most vehicles involved in the recall.
Takata’s airbags are more likely to explode if it is exposed to excessive heat or moisture, which means Floridians should look to see if a recall was issued for your car. (To check for recalls visit: https://vinrcl.safercar.gov/vin/).
If you are injured in a car accident that is tied to an auto recall, you have a more stringent burden of proof to meet when you bring a product liability claim. For one, the part or model recalled must be identified as the primary cause of the collision. A recall alone is not sufficient evidence, and a victim will need more evidence to prove their claim including expert testimony from an accident reconstruction specialist.
