Davidson County, Tennessee – Local news reported on a motorcycle rider who was killed when his bike collided with a truck in the Nashville area.
Police responded to Interstate 24 East in Davidson County to find that a pickup truck had fatally injured a motorcycle rider when they were near the entrance ramp of the highway. A 61 year old male was driving the motorcycle eastbound on Old Hickory Boulevard at night when a truck that was going westbound attempted to turn onto the interstate. The two vehicles collided at this point.
Emergency crews transported the victim to TriStar Skyline Medical Center, but he was pronounced dead shortly after arriving. The driver of the truck was a 48 year old male from Alabama who was not hurt during the collision. Police issued a citation to the truck driver for failure to yield, but no foul play or criminal activity was suspected. They also believe that neither party was under the influence of drugs or alcohol at the time of the crash.
When different types of motor vehicles collide
Because many different types of vehicles are on the roads at any given time, it is possible that a truck driver can make a mistake and hit a much smaller vehicle such as a motorcycle. The specific facts surrounding the accident are generally much more important from a legal standpoint than the types of vehicles involved. It is possible to file the same kind of lawsuit against the driver or a truck or car when they are at fault for any accident.
Accidents that involve commercial vehicles
One major difference is that most trucks are used for commercial purposes. This means that the business that owns the vehicle will normally be named as the defendant in the case rather than the individual truck driver. The business will usually have a better ability to pay out any claims to the plaintiff, instead of depending on all of the money coming from one worker. A business is also liable for any harm caused by its employees while they are working and in their normal daily routine.
Civil personal injury lawsuits
The process of filing a lawsuit against any driver at fault is done to make them pay a specific amount of damages. Your attorney will be able to file similar documentation whether your were riding in a car, motorcycle, or on foot when you were hit by a truck driver. A personal injury lawsuit essentially puts the defendant on notice that they were not careful enough while driving and caused various problems for the plaintiff. This usually includes injuries and associated medical treatment, along with property damage and missed time from work. A fatal accident can also be filed as a wrongful death lawsuit that allows the family members to make the same kind of claim that the victim could have, if they were still alive. Your lawyer can give more specific information about all of these types of cases.
